Under the SAB's authorizing statute, the Environmental Research, Development, and Demonstration Authorization Act of 1978, the SAB "may make available to the Administrator, within the time specified by the Administrator, its advice and comments on the adequacy of the scientific and technical basis" of proposed rules. The Environmental Protection Agency and the Department of the Army have proposed a revised definition of "waters of the United States" that clarifies federal authority under the Clean Water Act. A workgroup of the Science Advisory Board recommended that the SAB provide advice and comment on a number of scientific and technical issues regarding the proposed definition of waters of the United States. The full SAB considered the workgroup's recommendations and decided to provide a commentary to EPA on the proposed rule.
